Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period : the period within which the consumer may exercise their right of withdrawal.

  • Consumer : the natural person who is not acting in the exercise of a profession or business and who enters into a distance agreement with the entrepreneur.

  • Day : calendar day.

  • Long-term transaction : a distance agreement related to a series of products and/or services, for which the delivery and/or purchase obligations are spread over time.

  • Durable data carrier : any means that enables the consumer or entrepreneur to store information personally addressed to them, in a way that allows future consultation and unaltered reproduction.

  • Right of withdrawal : the option for the consumer to cancel the distance agreement within the cooling-off period.

  • Entrepreneur : the natural or legal person offering products and/or services at a distance to consumers.

  • Distance agreement : an agreement where, within the framework of an organized system for selling at a distance, only distance communication techniques are used.

  • Means of distance communication : tools that can be used for concluding an agreement, without the consumer and entrepreneur being together in the same space.

Article 3 – Applicability

These terms and conditions apply to every offer from the entrepreneur and to any distance agreement between the entrepreneur and the consumer.

Before concluding a distance agreement, the consumer is provided with these terms and conditions. If that is not reasonably possible, the consumer will be informed where to access them and that they will be sent free of charge upon request.

If the agreement is concluded electronically, these terms may be shared in such a way that the consumer can store them for later reference. In case of conflicting terms, the consumer may rely on the most favorable provision.

If any part of these conditions is invalid, the rest remains in force. Unregulated or unclear cases should be interpreted in the spirit of these terms.

Article 4 – The Offer

If an offer has a limited duration or special conditions, this will be clearly stated.

The offer is non-binding. The entrepreneur may change the offer.

Descriptions and images must be clear, accurate and not misleading. Color variations may occur. Any errors do not bind the entrepreneur.

The offer includes details such as:

  • Price (excluding import VAT or customs fees, which are paid by the customer)

  • Shipping costs

  • How the agreement is formed

  • Whether the right of withdrawal applies

  • Payment, delivery and performance terms

  • Validity of the offer

  • Communication costs if not standard

  • Archiving the agreement

  • How consumers can check and correct input

  • Available languages

  • Applicable codes of conduct

  • Minimum term in long-term contracts

  • Available sizes, colours, materials (if relevant)

Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and conditions.

If done electronically, the entrepreneur confirms receipt immediately. Until confirmed, the consumer may cancel.

The entrepreneur secures data transfer and the web environment.

The entrepreneur may verify the consumer's ability to pay and has the right to reject orders with justification.

Upon agreement, the entrepreneur provides:

  • The business address

  • Withdrawal information

  • Warranty and after-sales details

  • Any previously provided offer details

  • Cancellation rules for long-term contracts

Article 6 – Right of Withdrawal

Consumers may cancel a product purchase within 30 days of receipt without giving a reason.

During the cooling-off period, consumers should handle the product and packaging carefully.

To withdraw, notify the entrepreneur in writing within 30 days. The item must then be returned within 30 days. Proof of return must be provided, including returns to suppliers (eg in China).

If not returned in time, the purchase becomes final.

Article 7 – Return Costs

Return shipping costs are the consumer's responsibility, including returns to the country of origin (eg China).

Refunds are processed within 30 days, once the returned item is received or proven shipped.

Article 8 – Exclusion of Withdrawal

The right of withdrawal may be excluded for:

  • Custom-made items

  • Clearly personal products

  • Items that cannot be returned due to their nature

  • Perishable or expired goods

  • Market-dependent pricing

  • Newspapers/magazines

  • Sealed software/audio/video once opened

  • Hygiene products once opened

And services:

  • Related to lodging, transport, restaurants or leisure for a specific date

  • That has begun with consumer's consent before the withdrawal period ended

  • Gambling and lottery services

Article 9 – Price

Prices remain fixed during the offer period unless VAT changes.

For products influenced by market fluctuations, this is indicated.

Price changes within 3 months are only allowed if legally required.

After 3 months, increases are only allowed if agreed and if the consumer can cancel.

Prices exclude EU VAT/customs charges (handled by postal/courier service).

Typing errors are not binding.

Article 10 – Conformity and Warranty

Products must meet agreement, specs, normal use, and legal standards.

Manufacturer warranties do not limit statutory rights.

Defects must be reported within 30 days and returned in new condition.

No warranty if:

  • The consumer or others tampered with the product

  • The product was misused or not handled per instructions

  • Defect is due to government regulations

Article 11 – Delivery and Execution

The entrepreneur will handle orders with care.

Delivery is to the address provided by the consumer.

Orders are shipped within 30 days unless otherwise agreed. Delays are communicated within 30 days.

In such cases, the consumer may cancel and be refunded.

If an item is unavailable, a replacement may be offered, clearly marked as such. Replacements may still be returned.

Risk of loss or damage is with the entrepreneur until delivery.

Article 12 – Long-Term Contracts: Duration, Termination, Renewal

Termination
The consumer may cancel ongoing contracts at any time with up to 1 month's notice.

Fixed-term contracts can be canceled at the end with the same notice.

Termination must be as simple as signing up.

Renewal
Fixed-term contracts may not renew automatically, except:

  • Print subscriptions (max. 3 months), cancellable monthly

  • Indefinite renewal allowed if consumer can cancel anytime

Trial subscriptions end automatically.

Duration
If over 1 year, the consumer may cancel after one year with up to 1 month's notice.

Article 13 – Payment

Unless agreed otherwise, payment is due within 7 business days after the cooling-off period.

For services, the period starts upon confirmation of the agreement.

The consumer must report payment errors promptly.

In case of non-payment, the entrepreneur may charge reasonable collection fees.

Article 14 – Complaints

Complaints must be submitted in writing within 7 days of noticing a defect.

The entrepreneur responds within 30 days. If more time is needed, the consumer will be informed.

If no resolution is found, the dispute is subject to the dispute procedure.

Complaints do not suspend the entrepreneur's obligations unless confirmed in writing.

If justified, the entrepreneur may repair or replace the product.

Article 15 – Disputes

All agreements are governed by Dutch law, even if the consumer resides abroad.
